You've all probably heard me complain about empathy and bards before. Empathy is a bard's secondary stat, raising as a bard levels. Charisma is our primary stat, and also raises as we level. Charisma has been shown to be our mana pool. Unfortunately, there are very few decent charisma items out there. Empathy has been shown to do squat for bards. Nada. Nothing. Zip. And there are tons of empathy items around. This has been a huge source of debate and annoyance around the bard boards.
Anyway, I've tried contacting everyone I could think of to try and find out what's going on with this, and finally got a decent response from Sanya Thomas, Mythic's Internet Relations Manager. We sent a few emails back and forth and I did a little testing. And this is the last email I got from her. I really can't believe that the developers didn't know about this, though. People have been bitching about it for months.
I thought you'd appreciate seeing the spell developer's response to me forwarding your email:
"Well, I can't argue with testing. I'll do some myself, look at the code, and figure out what the heck is going on. Tell her thanks, and that Bards SHOULD be using Empathy.

So, for what it's worth, someone IS looking at this now. I couldn't tell you when you'll see results, but the guys are really good about following through as a general rule.
