Ok, I just read that the soldier who wrote this:

is being investigated for disloyalty under the following codes:

But the soldier who wrote this:

isn't.

I may have missed it but it's unclear if the second guy is an officer. I believe that's what seperates the cases. It's against the law for an active duty officer to question the lawful orders of his superiors. Or basically to say things that will hurt moral, yada, yada. I think a grunt can say whatever they like. It probably doesn't help their chances for promotion, but they aren't breaking the law. Rules is rules.
