I mean WTF? I certainly hope that's an elected judge, because that is ridiculous!
The summary...
Thompson, 50, had sexual contact over a couple of months last year with a 12-year-old girl, said Sidney Police Chief Larry Cox. He was sentenced on two felony sexual assault charges.
Cheyenne County District Judge Kristine Cecava issued the sentence Tuesday. She told Richard W. Thompson that his crimes deserved a long prison sentence but that he was too small to survive in a state prison.
Though he could have been sentenced to 10 years behind bars, he ended up with 10 years of probation instead.

Not sure about that state but in Michigan that would be an elected judge; well in Michigan every judge is elected.
One must ask... If he was to short for prison then why did he break the law? Had I been the judge I would have offered two options to the defendant:
1) Go to normal jail for your term.
2) Go to a super max for your term.
That way if he did not think he could make it in normal jail he could take the super max and be held alone in a cell for 23 hours a day with 1 hour rec time alone.

And a snippet from a comment elsewhere...
Ironically, the bio for District Judge Kristine Cecava of Cheyenne County includes “Her professional involvement has included the Nebraska Commission for the Protection of Children”. Someone needs to add the word “Abusers” to the end of the quote.

Are you f-ing kidding me?? OMG!!! Sweet!!! Think I can get away with murder now and have a probation period instead of jail time because I'm only 5'1"??
Dood this is totally sending the wrong messege to everyone! People are not above the law...and this guy is because he's short! GAH!

The judge's reasoning confounded Amy Miller, legal director for the Nebraska chapter of the American Civil Liberties Union.
"I have never heard of anything like this before," she said.
No one has ever come to the ACLU to complain of height discrimination, she said. And using Thompson's height as a reason to avoid sending him to prison is surprising, because neither the U.S. nor state constitution provides protections based on physical stature, she said.
